250th Anniversary of the United States Marine Corps Commemorative Coin Act This bill directs the Department of the Treasury to mint and issue not more than 50,000 $5 gold coins, 400,000 $1 silver coins, and 750,000 half-dollar clad coins emblematic of the 250th anniversary of the United States Marine Corps. All surcharges received by Treasury from the sale of such coins must be paid to the Marine Corps Heritage Foundation and shall only be used for the purposes of supporting the mission of the Marine Corps Heritage Center.

Veterans Benefits Improvement Act of 2023

Veterans Benefits Improvement Act This bill addresses certain requirements related to Department of Veterans Affairs (VA) medical disability examinations for purposes of benefit claims. First, the bill updates procedures related to the publishing of VA disability benefit questionnaire forms. Specifically, the VA does not have to publish certain forms if it determines the form could not reasonably be completed to a clinically acceptable standard by someone who is not an employee or contractor of the VA. The bill also requires the VA to report on its efforts to provide reimbursement for a veteran's travel to a facility, regardless of whether the facility is inside or outside of the United States, when such travel is incident to a scheduled compensation and pension examination. Additionally, the VA must partner with veterans service organizations and other stakeholders (as determined by the VA) to implement an outreach program for veterans regarding (1) contact information for contractors providing medical disability examinations, and (2) the requirement for veterans to provide personally identifiable information when contacted by such contractors to verify their identity. The VA must also include certain elements in contracts it enters with contractors to provide medical disability examinations. Specifically, every communication from a contractor to a claimant regarding the scheduling of such an examination must be contemporaneously transmitted to the appropriate representative for the preparation, presentation, and prosecution of claims. Finally, the VA must report on improving its support of governmental veterans service officers.

VET-TEC Authorization Act of 2023 This bill requires the Department of Veterans Affairs (VA) to permanently implement a program under which it provides up to 8,000 covered individuals per year the opportunity to enroll in high technology programs of education that provide non-degree training or skills related to computer programming, media application, data processing, or information sciences. A covered individual is a veteran who (1) the VA determines is under the age of 62, served an aggregate of at least 36 months on active duty, and was discharged or released from service under conditions other than dishonorable; or (2) will satisfy such requirements in fewer than 180 days after the VA's determination. In administering the program, the VA must provide assistance to covered individuals in amounts equal to those provided to Post-9/11 GI Bill recipients who are pursuing a degree on more than a half-time basis. The VA must seek to enter into contracts with any number of qualified providers of high technology programs of education and pay such providers a specified percentage of the tuition and other fees for each enrolled individual. The bill prescribes (1) requirements for a provider of a program to be considered as qualified (e.g., the provider employs instructors the VA determines are experts in their respective fields), and (2) criteria for the VA to approve providers for contracts. If a covered individual has remaining entitlement to other VA educational assistance, entitlement under this program must be charged at the rate of one month of that remaining entitlement for each month of assistance under this program.

Secure the Border Act of 2023 This bill addresses issues regarding immigration and border security, including by imposing limits to asylum eligibility. For example, the bill * requires the Department of Homeland Security (DHS) to resume activities to construct a wall along the U.S.-Mexico border; * provides statutory authorization for Operation Stonegarden, which provides grants to law enforcement agencies for certain border security operations; * prohibits DHS from processing the entry of non-U.S. nationals (aliens under federal law) arriving between ports of entry; * limits asylum eligibility to non-U.S. nationals who arrive in the United States at a port of entry; * authorizes the removal of a non-U.S. national to a country other than that individual's country of nationality or last lawful habitual residence, whereas currently this type of removal may only be to a country that has an agreement with the United States for such removal; * expands the types of crimes that may make an individual ineligible for asylum, such as a conviction for driving while intoxicated causing another person's serious bodily injury or death; * authorizes DHS to suspend the introduction of certain non-U.S. nationals at an international border if DHS determines that the suspension is necessary to achieve operational control of that border; * prohibits states from imposing licensing requirements on immigration detention facilities used to detain minors; * authorizes immigration officers to permit an unaccompanied alien child to withdraw their application for admission into the United States even if the child is unable to make an independent decision to withdraw the application; * imposes additional penalties for overstaying a visa; and * requires DHS to create an electronic employment eligibility confirmation system modeled after the E-Verify system and requires all employers to use the system.

National Defense Authorization Act for Fiscal Year 2024 This bill authorizes FY2024 appropriations and sets forth policies for Department of Defense (DOD) programs and activities, military construction, the national security programs of the Department of Energy (DOE), and the Maritime Administration. It also authorizes appropriations for the Defense Nuclear Safety Board and the Naval Petroleum Reserves. The bill authorizes appropriations but it does not provide budget authority, which is provided by appropriations legislation. DIVISION A--DEPARTMENT OF DEFENSE AUTHORIZATIONS TITLE I--PROCUREMENT This title authorizes appropriations for acquiring or modifying various military items (such as aircraft, ships, tracked combat vehicles, missiles, and ammunition) and sets policy for certain procurement programs. Below are some examples of provisions in this title. The estimate must determine whether the executive order will have * no significant impact on inflation, * a quantifiable inflationary impact on the consumer price index, or * a significant impact on inflation that cannot be quantified at the time the estimate is prepared. The requirement does not apply to executive orders that (1) provide for emergency assistance or relief at the request of any state or local government or an official of the government, or (2) are necessary for national security or the ratification or implementation of international treaty obligations.

Fiscal Responsibility Act of 2023 This bill increases the federal debt limit, establishes new discretionary spending limits, rescinds unobligated funds, and expands work requirements for federal programs. Specifically, the bill suspends the federal debt limit through January 1, 2025, and increases the limit on January 2, 2025, to accommodate the obligations issued during the suspension period. In addition, the bill establishes new discretionary spending limits for FY2024 and FY2025 that are enforced with sequestration (i.e., automatic spending cuts). It also changes the limits to 1% below the FY2023 base funding levels if a continuing resolution is in effect on or after January 1, 2024, or on or after January 1, 2025, because all 12 regular appropriations bills were not enacted by the end of the prior year. The bill also includes provisions that * rescind certain unobligated funds that were provided to address COVID-19 and to the Internal Revenue Service; * provide funding for the Department of Veterans Affairs Cost of War Toxic Exposure Fund; * provide funding for the Department of Commerce Nonrecurring Expenses Fund; * provide statutory authority through 2024 for the requirement for agencies that propose certain administrative actions that will increase direct spending to also propose at least one administrative action that will decrease direct spending by at least the same amount (commonly known as administrative pay-as-you-go rules); * terminate the suspension of federal student loan payments; * expand the work requirements for the Supplemental Nutrition Assistance Program (SNAP) and the Temporary Assistance for Needy Families (TANF) program; and * expedite the permitting process for certain energy projects.

Securing Growth and Robust Leadership in American Aviation Act This bill reauthorizes the Federal Aviation Administration (FAA) through FY2028, including activities and programs related to airport planning and development, facilities and equipment, and operations. The National Transportation Safety Board is also reauthorized through FY2028. The bill also addresses a wide range of issues. For example, the bill * directs the FAA to increase air traffic controller hiring targets; * establishes a workforce development program to support the education, recruitment, and retention of aviation professionals; * establishes an FAA Ombudsman to coordinate the response to submissions of inquiries or objections relating to issues such as aircraft certifications and registrations, pilot certificates, and operational approvals, waivers, or exemptions; * raises the commercial airline pilot retirement age to 67 (currently 65); * prohibits aircraft dispatchers from working remotely, with limited exceptions for emergencies; * requires the Department of Transportation (DOT) to establish standards to ensure the aircraft boarding and deplaning process is accessible for individuals with disabilities, including for individuals who use wheelchairs; * requires DOT to establish a policy directing certain air carriers to seat a young child next to an accompanying adult if adjacent seats are available without charging an additional fee; * prohibits the FAA from requiring mask wearing or COVID-19 vaccines for passengers, air carrier employees, or FAA employees; * requires the FAA to issue rules to update the requirements for testing and operating unmanned aircraft (i.e., drones), including for drones operating beyond the visual line of sight; and * requires the FAA to issue rules for certifying pilots for powered-lift aircraft (i.e., capable of vertical takeoff and landing) and operational rules for powered-lift aircraft.

TITLE I--DEPARTMENT OF DEFENSE This title provides appropriations to the Department of Defense (DOD) for Military Construction for * the Army; * the Navy and Marine Corps; * the Air Force; * Defense-Wide agencies and activities (other than military departments); * the Army and Air National Guard; and * the Army, Navy, and Air Force Reserves. The title also provides appropriations to DOD for the (1) North Atlantic Treaty Organization (NATO) Security Investment Program, and (2) the DOD Base Closure Account. The title provides appropriations to DOD for Construction and Operation and Maintenance of Family Housing for * the Army, * the Navy and Marine Corps, * the Air Force, and * Defense-Wide agencies and activities (other than military departments). The title provides appropriations to DOD for (1) the Family Housing Improvement Fund, and (2) the Military Unaccompanied Housing Improvement Fund. (Sec. 101) This section prohibits funds provided by this title from being used for payments exceeding $25,000 under a cost-plus-a-fixed-fee contract for construction in the United States without a specific DOD approval in writing. The section includes an exception for work that is to be performed in Alaska. (Sec. 102) This section permits construction funds provided by this title to be used for hiring passenger motor vehicles. (Sec. 103) This section permits construction funds provided by this title to be used for advances to the Federal Highway Administration for the construction of access roads DOD has certified as important to national defense. (Sec. 104) This section prohibits funds provided by this title from being used to begin construction of new bases in the United States without a specific appropriation. (Sec. 105) This section prohibits funds provided by this title from being used to purchase land or land easements in excess of 100% of the value as determined by the Army Corps of Engineers or the Naval Facilities Engineering Command. The section includes exceptions for (1) determinations of value by a federal court, (2) purchases negotiated by the Department of Justice, (3) values less than $25,000, and (4) purchases that are otherwise determined by DOD to be in the public interest. (Sec. 106) This section prohibits funds provided by this title from being used to acquire land, provide for site preparation, or install utilities for family housing, except housing for which appropriations have been provided. (Sec. 107) This section prohibits funds provided by this title for minor construction from being used to transfer or relocate any activity from one base or installation to another without notifying Congress in advance. (Sec. 108) This section prohibits funds provided by this title from being used to procure steel for construction unless American producers, fabricators, and manufacturers have been allowed to compete for the procurement. (Sec. 109) This section prohibits funds provided to DOD for military construction or family housing during the current fiscal year from being used to pay real property taxes in any foreign nation. (Sec. 110) This section prohibits funds provided by this title from being used to initiate a new installation overseas without notifying Congress in advance. Halt All Lethal Trafficking of Fentanyl Act or the HALT Fentanyl Act This bill permanently places fentanyl-related substances as a class into schedule I of the Controlled Substances Act. A schedule I controlled substance is a drug, substance, or chemical that has a high potential for abuse; has no currently accepted medical value; and is subject to regulatory controls and administrative, civil, and criminal penalties under the Controlled Substances Act. (The temporary scheduling order issued by the Drug Enforcement Administration to place fentanyl-related substances into schedule I of the Controlled Substances Act expires on December 31, 2024.) Under the bill, offenses involving fentanyl-related substances are triggered by the same quantity thresholds and subject to the same penalties as offenses involving fentanyl analogues (e.g., offenses involving 100 grams or more trigger a 10-year mandatory minimum prison term). Additionally, the bill establishes a new, alternative registration process for schedule I research that is funded by the Department of Health and Human Services or the Department of Veterans Affairs or that is conducted under an investigative new drug exemption from the Food and Drug Administration. The bill also makes several other changes to registration requirements for conducting research with controlled substances, including * permitting a single registration for related research sites in certain circumstances, * waiving the requirement for a new inspection in certain situations, and * allowing a registered researcher to perform certain manufacturing activities with small quantities of a substance without obtaining a manufacturing registration. Finally, the bill expresses the sense that Congress agrees with the interpretation of Controlled Substances Act in United States v. McCray, a 2018 case decided by the U.S. District Court for the Western District of New York. In that case, the court held that butyryl fentanyl, a controlled substance, can be considered an analogue of fentanyl even though, under the Controlled Substances Act, the term controlled substance analogue specifically excludes a controlled substance.

In particular, the bill specifies that a student's available income shall not be less than -$1,500 for award year 2024-2025 and not less than $0 for award year 2025-2026 and each succeeding award year. The bill also provides specified additional funds for Federal Pell Grants for FY2025 and each succeeding fiscal year.

The bill requires the VA to establish an advisory council on health care and benefits for covered children. Additionally, the VA must establish care and coordination teams for covered children. At least every 180 days, the teams must conduct outreach to ensure the continued care of the children and assist with any necessary changes in care. The VA must report to Congress a list of conditions that will trigger outreach to covered children, and must attempt to contact such children as soon as practicable after the identification of a condition. The Veterans Benefits Administration and the Veterans Health Administration must enter into a memorandum of understanding to better assist covered children.

VA Medicinal Cannabis Research Act of 2023 This bill requires the Department of Veterans Affairs (VA) to study the effects of cannabis on veterans who are enrolled in the VA health care system and have been diagnosed with post-traumatic stress disorder (PTSD) or chronic pain (i.e., eligible veterans). First, the bill requires the VA to conduct an observational, 18-month study on the effects of cannabis on the health outcomes of eligible veterans. The VA must report on the study and address whether it is able to meet criteria necessary to conduct clinical trials. Then, if the VA determines that it is able to proceed, it must carry out a series of clinical trials on the effects of cannabis appropriate for investigational use, as determined by the Food and Drug Administration, on the outcomes of eligible veterans. The VA must carry out a long-term observational study of the clinical trial participants. The VA may terminate the trials if it is unable to meet clinical guideline requirements or the trials would create excessive risk to participants. The VA must ensure that the study and trials are representative of the demographics of veterans in the United States, as determined by the most recent data from the American Community Survey of the Bureau of the Census. The study and trials must include mechanisms to ensure data preservation and registration as necessary (in an anonymous form).

The BIA must notify lenders upon receipt of such documentation, perform a preliminary review of such documents not later than 10 days after receipt, and approve or disapprove of such documents within 20 or 30 days, depending on the type of application. Additionally, the bill sets forth requirements for the BIA regarding (1) response times for the completion of certified title status reports, (2) notification of delays in processing, and (3) the form of notices and delivery of certain reports. The bill also provides relevant federal agencies and Indian tribes with read-only access to the Trust Asset and Accounting Management System maintained by the BIA. The Government Accountability Office must report on digitizing documents for the purpose of streamlining and expediting the completion of mortgage packages for residential mortgages on Indian land. Finally, the bill establishes within the BIA's Division of Real Estate Services the position of Realty Ombudsman.
